AASA hails court decision to delay NLRB posting rule

In an action applauded by AASA and MEMA, a U.S. Court of Appeals delayed a federal rule which would require employers to post a notice outlining an employee’s right to unionize.

In an action applauded by the Automotive Aftermarket Suppliers Association and the Motor & Equipment Manufacturers Association (MEMA), a U.S. Court of Appeals has delayed a federal rule which would require employers to post a notice outlining an employee’s right to unionize.

The U.S. Court of Appeals for the District of Columbia granted an injunction today in the case brought by the National Association of Manufacturers (NAM) challenging the National Labor Relations Board (NLRB) posting rule, delaying April 30 effective date until the Court has a chance to hear arguments and issue a ruling. MEMA had filed an amicus brief supporting NAM’s position on behalf of AASA and affiliate associations Heavy Duty Manufacturers Association (HDMA), Motor & Equipment Remanufacturers Association (MERA) and Original Equipment Suppliers Association (OESA). 


“This is a very significant development,” says Bob McKenna, MEMA’s president and CEO. “The posting rule is part of an aggressive, unnecessary agenda that the NLRB has been promoting, and this decision correctly calls the validity of the posting rule into question.”

“AASA aftermarket suppliers and their fellow parts manufacturers view the recent direction of the NLRB as potentially destructive to job creation and growth,” says Steve Handschuh, president and COO of AASA. “We are very pleased by the Court’s decision and hope it offers the chance to fully examine NLRB authority and limit its ability to issue unnecessary rules and decisions.”
