Massachusetts Right to Repair goes to governor for signature

The Massachusetts Senate passed legislation, which reconciles Right to Repair legislation signed into law last year and the voter referendum passed by the voters last November.

The Massachusetts Senate passed legislation supported by AASA, MEMA, CARE, AAIA, the Alliance of Automobile Manufacturers and the Association of Global Automakers, which reconciles Right to Repair legislation signed into law last year and the voter referendum passed by the voters last November.

The bill is on the governor’s desk, who is expected to sign it into law.

An amendment was agreed to that brings certain heavy duty and commercial vehicles under the law; the amendment was considered minimal and was accepted and agreed to by Engine Manufacturers Association (EMA) and its member companies. The amendment expands coverage of the bill to include “heavy duty vehicles that are not heavy duty vehicles built to custom specifications sold in the commonwealth for commercial purposes”.

The legislation calls for compliance for light duty cars and trucks beginning with Model Year 2018; allows multiple interfaces for diagnostic information, and provides manufacturers with protections for Intellectual Property.

AASA and MEMA have supported this legislation as a model solution for all 50 states.

The New Jersey legislature held a hearing on its own version of Right to Repair, but its prospects for advancing through the legislature are uncertain.

AASA and MEMA have weighed in urging the New Jersey legislature to adopt the Massachusetts language on this issue in an effort to promote a uniform program.
