WASHINGTON, D.C. — South Dakota Senate Bill 103, introduced by state Sen. Nancy Turbak and aimed at establishing certification provisions regarding the use of replacement crash parts in the repair of certain motor vehicles, was tabled during a House hearing. The bill was introduced Jan. 16, was passed in the state Senate Jan. 25 and then moved to the House Commerce Committee, which held the hearing.

In comments submitted to the committee, Bob Redding, ASA Washington, D.C., representative, said: “ASA supports a competitive marketplace. Our members use original equipment manufacturer parts, aftermarket parts, recycled parts, etc. We believe that Senate Bill 103 opens the door for a conflict of interest for those entities that may certify what types of parts are acceptable or not acceptable.”

ASA opposes state parts certification bills, believing that owners should have notice and consent in writing to the use of replacement crash parts in the repair of their vehicle.
